IT IS FINALLY POSSIBLE TO SEAL YOUR CRIMINAL CASE IN ARIZONA

Under a new state law, Arizonans with a criminal record are able to seal their criminal records, which may make it possible for them to regain access to options like public housing assistance and a wider range of career opportunities.

On December 31, 2022, new legislation went into effect, which was codified as A.R.S. § 13-911. This new statute allows people to seal most Arizona criminal records, thereby allowing them to more fully rejoin society. Eligible criminal cases cannot be sealed by the court until after all court-ordered requirements have been met and the subsequent time has passed since the person completed the conditions of probation or sentence, including fines/fees and restitution to all victims, and was discharged by the court.

1. Ten years for a class 2 or 3 felony.
2. Five years for a class 4, 5 or 6 felony.3. Three years for a class 1 misdemeanor.4. Two years for a class 2 or 3 misdemeanor.

You may be eligible to request the courts seal your criminal case once you have completed all court-ordered requirements and the aforementioned period of time has passed since the person completed the conditions of probation or sentence and was discharged by the court.

If your case is approved to be sealed, you will be permitted to claim on applications for work, financial assistance, loans, and housing that you have never been accused of, prosecuted for, or convicted of a crime.
