I’m attorney Andrew Long Rising Phoenix Law Group. I wanna talk about simulated weapons under Arizona law. By simulated weapons, I mean BB guns, airsoft guns, fake guns, or any other thing that is not an actual firearm, but looks like an actual firearm. Under Arizona law, you can be charged as though you did use a real firearm, even though you know that it is not a real gun, but a BB gun or airs.Laws that are examples of this are ARS 13 1 904, which is the statute for armed robbery, both a one and a two paragraphs of that statute. If you are armed with a deadly weapon or a simulated deadly weapon, or you use or threaten to use a dead deadly weapon or dangerous instrument, or a simulated deadly weapon, you are charged and you are facing the same consequences as though you used a real firearm. Another example of this would be the aggravated assault statute in Arizona, ARS 13-1204 and the 11th paragraph of that statute, if you use a simulated deadly weapon, again, could be a BB gun, an airsoft gun, but if it looks like a real weapon, you are charged the same and you are facing the repercussions or consequences.

In conclusion, under Arizona law, regardless of whether you use an airsoft gun, a BB gun, any object that looks like a firearm or a real firearm itself, you are facing the same consequences.
